1. Booking Process

Any quotation is normally based on the information available at the time and may be revised if the site conditions or scope differ from what was described.

3. Payments
Unless otherwise agreed in writing, payment is due immediately upon completion of the work. Accepted payment methods may include bank transfer, card payment, or other methods agreed in advance. Cash may be accepted only where expressly permitted by the service provider.
Invoices must be paid in full by the due date shown. The service provider may also suspend future bookings or withhold completion documentation until outstanding balances are settled.

4. Cancellations, Postponements, and Delays
The client may request cancellation or postponement by giving reasonable notice. If a booking is cancelled after the service provider has reserved time, ordered materials, dispatched staff, or incurred other preparation costs, the provider may charge a cancellation fee or retain any deposit to cover losses, to the extent permitted by law and proportionate to the circumstances.
If the client cancels on the day of attendance, fails to provide access, or is otherwise unavailable for the scheduled work, the service provider may treat this as a late cancellation or wasted visit. In such cases, a call-out or minimum attendance charge may be applied. The provider will act reasonably and will not impose charges that are unfair or disproportionate.

Where possible, an alternative date will be offered. 5. Liability and Risk

The client acknowledges that branches, wood chips, timber, sawdust, and machinery may cause disturbance or minor surface impact even where reasonable precautions are taken.
The service provider will not be liable for loss or damage arising from information supplied by the client that is incomplete, inaccurate, or misleading. This includes inaccurate boundary information, undisclosed underground services, hidden hazards, or failure to disclose protected tree status or other restrictions. The client should ensure that all relevant information is provided before work begins.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded under UK law. Subject to that, the service provider’s total liability for any claim arising from the services shall be limited to the amount paid or payable for the specific work giving rise to the claim, unless otherwise required by law.
6. Waste Regulations and Site Clearance
The handling, transport, and disposal of green waste, timber, arisings, soil, and related materials will be carried out in accordance with applicable UK waste legislation and environmental requirements. Unless agreed otherwise, the service provider will remove only the waste described in the quotation. The client should not assume that all material will be taken away unless this is specifically included.
Waste transfer and disposal may be recorded where required by law or by the service provider’s operating procedures. The client agrees that material arising from the works may be transported to an authorised facility, recycling centre, composting site, or other lawful destination. No waste will be fly-tipped, burnt unlawfully, or disposed of in breach of regulatory obligations. The service provider may decline to remove contaminated, hazardous, or restricted waste unless appropriate arrangements have been made.
If the client requests timber to be left on site, stacked, or processed into smaller sections, this must be agreed before or during the job. The service provider is not responsible for the future use, storage, or condition of any material left behind at the client’s request. The client is responsible for ensuring that waste storage on the property does not create a nuisance, safety issue, or regulatory breach.
7. Client Responsibilities
The client must provide safe and lawful access to the site, including access for vehicles, machinery, and personnel where required. The client must remove or secure items that may be damaged by operations, such as vehicles, garden furniture, ornaments, fragile structures, and temporary installations. Where underground cables, pipes, or services may be present, the client should disclose them in advance and, where necessary, arrange checks before work starts.
If the client or a third party is present during the work, they must remain clear of exclusion zones and follow any safety instructions given by the crew. Children, pets, and unauthorised persons should not enter the work area. The client acknowledges that tree surgery is potentially hazardous and agrees not to interfere with equipment, climbing systems, rigging operations, or machinery.
The client must also ensure that payment can be made in accordance with the agreed terms and that any disputes are raised promptly and reasonably. Delayed complaints may make it harder to investigate issues while evidence is still available.
8. Complaints, Defects, and Aftercare
If the client believes the work has not been completed in accordance with the agreed scope, the client should notify the service provider as soon as reasonably possible and provide details of the concern. The provider may request an opportunity to inspect the issue and, where appropriate, remedy any genuine defect. Minor variation in appearance is not necessarily a defect, particularly in pruning or reduction work where the result depends on tree form, species, and seasonal conditions.
Natural regrowth, weather effects, and ongoing tree movement are outside the control of the service provider. No guarantee is given that a tree will remain in a specific condition indefinitely, or that further maintenance will not later be required. 9. Governing Law
These Terms and Conditions, and any dispute or claim arising from them or in connection with them, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, except where another forum is required by applicable law. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in full force.
These terms may be updated from time to time to reflect changes in law, operational practice, or service requirements. The version in force at the time of booking will apply to that booking unless a later written agreement states otherwise. Continued use of the service after changes have been notified will be treated as acceptance of the revised terms for future work.
